Court Bars VIO From Impounding, Confiscating Vehicles Or Impose Fines On Motorists

Justice Evelyn Maha of the Federal High Court in Abuja has issued an order barring the Directorate of Road Traffic Services, also called the Vehicle Inspection Office (VIO), from further stopping vehicles on the road, impounding or confiscating vehicles, and imposing fines on motorists.

In a judgement on Thursday, Justice Maha issued the order on a fundamental rights enforcement suit filed by a human rights activist and public interest attorney, Abubakar Marshal.

Also affected by the order are the Director of Road Transport; the Area Commander, Jabi, and the team leader, Jabi, and the Minister of the FCT, also listed as respondents.

Justice Maha upheld Marshal’s argument that no law empowers the respondents to stop, impound, confiscate, seize, or impose fines on motorists.

The judge declared that they are not empowered by any law or statute to stop, impound, or confiscate the vehicles of motorists and impose fines on motorists.

She proceeded to issue an order restraining them from confiscating the vehicle of motorists, or imposing a fine, as doing so is wrongful, oppressive, and unlawful by themselves.

Justice Maha ordered a perpetual injunction restraining the respondents from further violating the rights of Nigerians to freedom of movement, presumption of innocence and right to own property without lawful justification.

Landlord Loses Five Children In Ibadan Building Collapse

Tragedy struct in Ibaday, Oyo state Capital as a landlord, Pa Bibire Lamidi yesterday lost five of his children and grandchildren in a building collapse.

Five others were confirmed dead, while eight people were injured.

The one-storey building located at Jegede, Olunloyo, Ona Ara Local Government Area was said to have collapsed at about 2am yesterday

One of Pa Lamidi’s wives, Alhaji Yidiatu Lamidi, in an interview with reporters, said: “I was not there when the incident occurred. My husband told me that he just finished toileting when he suddenly saw the house collapsing. His children and grandchildren were among the victims.  My husband treats mentally ill and other patients. Five of his children and grandchildren have died in the incident. Some of his mentally ill patients also lost their lives.”
When asked if the building had shown any sign, she said: “The house showed no sign of weakness.  This looks like a spiritual attack.”
Pa Lamidi was still receiving medical treatment as at press time.

32-Year-Old Man Found Dead In Hotel In Ogun

A 32 years old man, Lanre Ogungbe, dead body  was discovered in a hotel room at Soyoye in Abeokuta, the state capital.

The Command’s spokesperson, SP Omolola Odutola,  confirmed in a statement on Friday that  the incident occurred at 2 p.m. on Thursday.

Odutola explained that a bottle of one alcoholic drink called “Lakoko” and another bottle of pesticide known as “sniper” was found beside the deceased in the hotel room.

She stated that on Thursday at 3 p.m. the owner of Authentic Hotel on Soyoye road reported the incident to the Divisional Police Officer of Lafenwa Police Station.

“He (the hotel owner) explained that around 2 p.m. of that same day, his hotel’s manager raised an alarm at the hotel and informed him about a customer later identified as Lanre Ogungbe, who had come to the hotel for a short rest.

“The receptionist, after noticing that the customer had not  been seen, went to check on him and discovered his lifeless body on the bed.

“She immediately notified the manager, who then alerted the hotel owner.

“They condoned off the scene, leaving the exhibits untouched before the complainant made a formal report of  the incident to the police,” Odutola said.

She said police detectives reacted swiftly, and found the deceased on the bed, alongside an empty bottle of “Lakoko” and a bottle of “sniper”, suspected to have been consumed by him.

“There were no signs of violence found on his body.

“His remains were evacuated to General Hospital in Ijaiye for medical examination, where he was pronounced dead and his body deposited in the morgue for a post-mortem examination,” the spokesperson said.

Odutola said a thorough investigation was ongoing on the matter.

71-year-old man, Sule Adeola sentenced to Life Imprisonment

A 71-year-old man, Sule Adeola, has been sentenced to life imprisonment by an Ekiti State High Court for raping a 10-year-old girl.

The defendant was charged to court on June 22, 2023, on one count bordering on rape.

The charge read, “That Sule Adeola on June 2, 2023, at the Federal Housing Estate in Ado Ekiti did rape a 10-year-old girl, contrary to Section 31(1) of the Child Rights Law, Cap. C7, Laws of Ekiti State, 2012.”

The 10-year-old victim living with her grandmother had said the defendant, who was her grandmother’s neighbour, violated her between 2021 and 2023, but she did not tell her grandmother initially because the defendant had promised to kill her.

To prove his case, the prosecutor, Julius Ajibare, called four witnesses and tendered the defendant’s statement and medical report as exhibits.

The defendant spoke through his counsel, Adefolaju Ayobioloja, and called three witnesses.

In the judgment on Wednesday, Justice Blessing Ajileye said, “It is unfortunate and saddening that recorded cases of intimate persons’ sexual assault hit new heights every day.

“From the totality of evidence on record, I am more persuaded by the prosecution’s evidence that there was proof of penetration, there is no scintilla of evidence available to the contrary. In all, I found that the prosecution proved the most essential ingredient of rape i.e. penetration. The defendant penetrated the vagina of the victim and I so hold.

“The defendant, Sule Adeola, is found guilty of the offence of rape of a 10-year-old girl as charged. He is, accordingly, sentenced to life imprisonment,” the judge pronounced.
